l+trl RE,SOLUTION RESOLUTION APPROVING THE REVISION OF POLICE POLICY 250, ATTENTION TO DUTY AND REVISION OF POLICE POLICY 556.20, SECURITY OF DEPARTMENT- UTILIZED VEHICLES AND EQUIPMENT IVHEREAS, Policy 250 provides various responsibilities of police employees to perform their duties; and WHEREAS, Policy 250 has been revised to clarify these responsibilities and to rnake the language gender neutral; and WIIERSAS, Policy 250 is in Attachment "A" of the Resolution; the new language is in bold and a strike-through is used to show words to be deleted; and WHE'RDAS; Policy 250 has-been reviewed and approved by the Fraternal Orderof Police; and WHEREAS, Policy 556 addresses various matters relating to the operation and security of department-utilized vehicles and equipment; and WHEREAS, Policy 556.20 has been revised to incorporate Police Rule 400, Vehicle Security, which prohibits employees from disengaging any security or anti+heft device on a department-utilized vehicle; and WHEREAS, Policy 556.20 has been revised to permit canine officers to leave their vehicles running while unattended when necessary for the health of their police dog as long as they engage the vehicle's antitheft system; and WHEREAS, Policy 556 is in Attachment "B" of the Resolution; the new langsage is in bold and a strike-through is used to show words to be deleted; and II'HEREAS, Policy 556 has been reviewed and approved by the Fraternal Order of Police; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of The City of Oklahoma City that the adoption of Police Policy 250, Attention to Duty and Policy 556.20, Security of Department-Utilized Vehicles and Equipment are approved. Employees of this department shall operate department-utilized vehicles and equipment in a lawful and proper manner at all times with due regard for the safety of all persons and with due regard for maintaining the proper condition of the vehicle or equipment itself. All drivers and front seat passengers occupying any dipartment-utilized vehicle or equipment shall wear properly fastened restraint devices. Adopted9 0l; Revised l0O8; Revised lilS 556.10 Pursuitr Involving Police Vehicles A pursuit is an active attempt by an officer in an authorized emergency vehicle to perfbrm a vehicle stop, and the operator of the suspect vehicle indicates by hiVher action, intent to elude or evade apprehension. The officer must reasonably believe the suspect(s) knows he/she was directed to stop, refused to stop, and was willfully fleeing in an attempt to avoid capture by using high speed driving or other evasive tactics. Effort should be made to avoid pursuits due to the extreme danger present in such activity. Officers shall consider the risk to the public (and themselves) in any pursuit. Officers of the department must balance the need for immediate apprehension of the suspect with the need to protect the public from the danger caused by the pursuit. All officers are reminded that their basic responsibility is to protect the public. When the danger of a pursuit exceeds the value of an immediate apprehension, public safetyshall be paramount and require alternative methods of apprehension, Revised 9.0 I ; Revised 9106; Revised t il 8 556.20 Security of Department-Utilized Vehicles Employees shall lock and remove keys from any department-utilized vehicles or equipment rvhen left unattended, except in emergency situations. Employees shall not disengage or turn off any security or anti-theft device on a department-utilized vehicle. Officers shatl remove all firearms from department-utilized vehicles while offduty, unless actively working an extra-dutyjob. Canine officers may leave a vehicle running rvhile unattended when necessary for the health of their police dog ifthey engage thc vehicle's anti-theft system that prevents the rehicle from being driven. City-issued firearms; 2. Ciry-issued portable radio; or J. City-issued conducted electricat weapons. While off duty, officers shall remove from any vehicle or secure in the trunk the follorving equipment: l. City-issued body arnor; or 2. Any uniform items with OCPD markings. Officers may leave any other city equipment in a vehicle while offduty, but shall secure the vehicle if it is left unattended.
