The Planning Commission heard this case on November 18, 1976. However, it has been returned upon adv'ice by'lega1 for a change in the wording from: t'Vacate", to: "Annul1, Vacate or Discontinue". The Oklahoma Urban Authority filed this application to vacate certain streets and alieys in the John F. Kennedy Urban Renewal Project, No.Oklahoma R-35. This area is located south of N.E. 4th Street between l4assachusetts Avenue and Rhode Island Avenue. The subject area 'is currently zoned "I" Light Industrial District. The area to the south is zoned "J" Heavy Industry District and developed with heavy industrial uses. This request conforms to the John F. Kennedy Urban Renewal Plan, Project No. Oklahoma R-35. There are several utilities within these streets and alleys. All utility companies have no objections to the vacation to this easement to vehicular traffic, so long as ail their utility rights are reserved. Al1 rights of the City and public franchise holders are hereby expressly reserved. AII appropriate City departments have reviewed this request for street and alley vacation and have no objections. He stated that this area was a very nice area, and he wanted to de- Velop a good industrial type park here but canrt use the area. He also recom- mended that the 200 foot rrD-llr for parking so there wouldnrt be any industry within 200 feet of the site-proof fence. Commissioner Smi ley requested that Mr. Col I ins and the property owners to get together and work out some kind of agreement so the Council can take action on it. Mr. Collins stated that he would be happy to work out something with the pro- perty owners because he wanted this worked out right. Jack Crockett suggested that if the applicant or protestants would consider a birm, that they put this in a covenant between the parties, because if this pro- perty should be rezoned, with fhe understanding there would be a birm, the ap- pl icant could prevent someone from obtaining a bui lding permit.
